Terms of Service

Welcome to the VDO.Ninja Video Capture Extension (the "extension"). The extension is provided by Steve Seguin ("we", "us", or "our"). By installing or using the extension, you agree to be bound by the following terms and conditions. Please read them carefully. If you do not agree, do not install or use the extension.

1. Acceptance of Terms

• By accessing or using the VDO.Ninja Video Capture Extension, you agree to these Terms of Service and our Privacy Policy
• These terms supplement the VDO.Ninja Terms of Service when using VDO.Ninja services through this extension
• You must be old enough to form a binding agreement where you live, or have permission from a parent or guardian who agrees to these terms for you

2. Description of Service

• The VDO.Ninja Video Capture Extension provides a browser-based tool for capturing and streaming video content via peer-to-peer networking
• The extension utilizes the VDO.Ninja platform for WebRTC video and audio communication
• We offer this extension free of charge
• We do not host, store, review, or monitor the content you capture or stream. Streams travel between your browser and your viewers, sometimes through relay servers that pass encrypted data without inspecting it

3. User Obligations

• You agree to use the extension lawfully and ethically
• You are responsible for maintaining the confidentiality of any stream ID, room name, password, or viewer link used in the service
• You must respect the intellectual property rights of content you capture and stream
• You are responsible for complying with the terms of service of websites you capture content from
• Before capturing, streaming, or recording any person, including participants in calls or meetings, you must obtain every consent required by applicable law and by the platform you capture from

4. Prohibited Uses

• You may not use the extension for any illegal or unauthorized purpose
• Harassment, abuse, or harm to another person or group is strictly prohibited
• You may not stream copyrighted content without proper authorization
• You may not circumvent DRM or other content protection measures
• You may not use the extension to violate the privacy of others, including capturing or streaming people without required consent

5. Intellectual Property

• The VDO.Ninja Video Capture Extension and its original content, features, and functionality are protected by copyright and other intellectual property laws
• The extension's source code is licensed under the MIT License, with the bundled VDO.Ninja SDK 1.6.2 component licensed under MPL-2.0. Those licenses govern the code
• The source code is available on GitHub
• The names "VDO.Ninja" and "VDO.Ninja Video Capture", and their logos and branding, are ours. The software licenses do not grant any right to use them, and modified versions must not be presented as official or endorsed by us

6. User-Generated Content

• You are solely responsible for the content you transmit or share using the extension
• You retain all rights to content you create, but grant necessary licenses for transmission via P2P networks
• You represent that you have all necessary rights and consents to stream any content you capture
• Copyright or other complaints about a stream should be directed to the person who published it. Because we do not host streams, we cannot remove them, but you may report abuse of VDO.Ninja services to steve@seguin.email

7. Privacy

• Your use of the extension is subject to our Privacy Policy
• When streaming via VDO.Ninja, the VDO.Ninja Privacy Policy also applies

8. Disclaimers

• To the maximum extent permitted by law, the extension and related services are provided "as is" and "as available", with all faults and without warranties of any kind, express, implied, or statutory
• We specifically disclaim all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranties arising from course of dealing or usage of trade
• We do not guarantee continuous, uninterrupted, secure, or error-free operability of the extension or services, or that they will work with any particular website
• We are not responsible for the quality, accuracy, or legality of user-generated content
• We do not endorse or assume responsibility for third-party content accessed through the extension

9. Limitation of Liability

• To the maximum extent permitted by law, we, our affiliates, contributors, and licensors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages
• We are not liable for any loss of profits or revenues, whether incurred directly or indirectly
• We are not liable for any loss of data, use, goodwill, or other intangible losses
• We are not liable for content captured, streamed, or recorded by you or by your viewers
• Our total liability for all claims relating to the extension shall not exceed one hundred Canadian dollars (CAD $100)
• These limits apply to every theory of liability, including contract, tort (including negligence), and statute, even if we were advised of the possibility of the damages

10. Indemnification

• You agree to indemnify and hold harmless us, our affiliates, contributors, and licensors from any claim, demand, loss, or expense, including reasonable lawyers' fees
• This includes claims made by any third party due to or arising out of your breach of these Terms or your use of the extension
• This includes your violation of any law or the rights of a third party, including intellectual property, privacy, and publicity rights, and claims by people you captured or streamed

11. Termination

• We may terminate or suspend access to our service immediately, without prior notice or liability
• Termination may occur for any reason whatsoever, including, without limitation, if you breach the Terms
• You may terminate your use of the extension at any time by uninstalling it from your browser
• Sections on intellectual property, user content, disclaimers, limitation of liability, indemnification, and governing law survive termination

12. Changes to Terms

• We reserve the right, at our sole discretion, to modify or replace these Terms at any time
• The date on this page shows when the Terms last changed, and changes will be reflected in the extension's version history on GitHub
• Continued use of the extension after changes constitutes acceptance of the new Terms

13. Governing Law

• These Terms shall be governed by and interpreted in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable there
• This applies without regard to conflict of law provisions
• You agree to submit to the exclusive jurisdiction of the courts located in Ontario, Canada for any disputes, unless the law where you live gives you a right to bring a claim elsewhere
• To the extent permitted by law, any claim must be brought individually, and not as a plaintiff or class member in any class, collective, or representative proceeding
• To the extent permitted by law, any claim relating to the extension must be started within one year after it arises, or it is permanently barred
• To the extent permitted by law, you waive any right to a jury trial

14. Browser Permissions

• The extension requires certain browser permissions to function
• By installing the extension, you grant these permissions as described in our Privacy Policy
• You understand that the extension can access video content on web pages you visit

15. Third-Party Services

• The extension relies on VDO.Ninja for WebRTC functionality
• Use of VDO.Ninja services is subject to their terms and conditions
• We are not responsible for the availability or functionality of third-party services or websites
• The extension is not affiliated with, endorsed by, or sponsored by YouTube, Google, Discord, Twitch, Microsoft, Netflix, or any other website or service it can be used with. Their names are trademarks of their respective owners and are used only to describe compatibility

16. General

• These Terms, together with the Privacy Policy, are the entire agreement between you and us about the extension
• If any provision is found unenforceable, it will be limited to the minimum extent necessary and the remaining provisions stay in effect
• Our failure to enforce any provision is not a waiver of our right to enforce it later
• You may not transfer these Terms. We may transfer them in connection with a transfer of the extension
